Forrester v. Peel Regional Police Services Board, 2006 HRTO 13

Facts:

Pre-operative transsexual women strip searched at station/done by man she asked for a women. Second one was a split search (male did bottom, female did top)

Issue(s):

Should a transsexual person be given the option of having a male or female strip-search them?

Ratio:

Transsexual detainee has choice of what sex of police officer will strip search them, and split-searches should be offered.

Holding:

Police did violate the code. Ontario Police would develop a new policy
