Facts:

M suffering financial difficulties. Did not want his wife to suffer. Shot her and tried to commit suicide. Doctor said he didn’t have ability to decide little matters

What is the meaning of planned and deliberate in the context of murder?

Ratio:

Can only be found guilty of capital murder if it can be found that the murder was BOTH planned and deliberate.
**“Deliberate” means considered not impulsive

Analysis:

The mental state of M would play a role in assessing whether it was deliberate – it is up to the jury to decide
