A convention was made (British Empire adopted it), Canada adopted it. A reference was made to the SC to determine validity


Did the Dominion have the authority to enact the leg?


Aerial navigation belongs to the Dominion because of:
• The terms of s.132
• The terms of the Convention
• S.91 (2) (5) and (7)


Parliament was competent to pass the act and authorize the regulations in question


Regulation of aviation is a matter for the Dominion
